b) All information provided through AVIQ should be verified against official FAA publications, regulations, and guidance.
c) AVIQ is designed as a supplementary learning tool and is not a replacement for proper flight instruction, training materials, or guidance from certified flight instructors.
By using AVIQ, you explicitly acknowledge and agree that:
a) You are solely responsible for verifying any information obtained through the Service before applying it to actual aviation activities, examinations, or flight operations.
b) You will exercise professional judgment when using information obtained through AVIQ.
c) You will not rely exclusively on AVIQ for critical aviation knowledge or decision-making.
d) You understand that aviation safety requires multiple layers of verification and that no single source of information should be relied upon exclusively.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
a) THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
b) THE COMPANY SHALL NOT BE LIABLE FOR ANY DAMAGE, LIABILITY, OR LOSS ARISING FROM: (i) YOUR USE OF OR RELIANCE ON THE SERVICE OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY TRANSACTIONS OR RELATIONSHIPS BETWEEN YOU AND ANY THIRD PARTY SERVICE PROVIDER; OR (iii) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR CONTENT, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
c) THE COMPANY EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY AVIATION ACCIDENTS, INCIDENTS, FAA VIOLATIONS, EXAMINATION FAILURES, OR OTHER NEGATIVE OUTCOMES THAT MAY OCCUR FOLLOWING THE USE OF INFORMATION OBTAINED THROUGH AVIQ.
d) YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK AND THAT THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your reliance on any information obtained from the Service for aviation-related activities.
